About Us
- Veruda Sailing School and other programs are offered by Veruda Consulting (hereinafter: The Service Provider), owner Robert Šarić, unless explicitly stated otherwise.
- The Service Provider is not responsible for services offered by other providers.
Participation Requirements
- Minimum age of 18 years, or 16 years with written parental/guardian consent.
- Sound health and swimming ability.
- Acceptance of the program, schedule, and inherent risks of sailing.
- Adherence to the program and schedule. Severe breaches, disruption, or substance use may result in suspension without refund.
- No refunds for voluntary withdrawals.
Reservations
- The person making the reservation must be at least 18 years old and legally competent.
- They are responsible for the accuracy of all personal details and information on all participants, as well as communicating all information received from The Service Provider to other participants.
- Reservations for individuals between 16 and 18 years old require parental/guardian accompaniment or written consent.
- Additional limitations or conditions may exist for certain programs and can be found in their descriptions.
Prices
- All advertised prices are accurate at the time of publishing but may be subject to change without prior notice.
Included in the Course Fee
- Sailing Yacht: A fully equipped sailing yacht for comfortable cruising.
- Accommodation: Shared cabin accommodation on board. Single-use cabins may be available upon request, subject to availability, for a 60% surcharge on the course fee.
- Onboard Amenities: Free unlimited Wi-Fi, use of self-inflatable automatic (if available) or foam life jackets, bed linens, towels, basic toiletries, and mosquito repellent.
- Basic Provisions: Coffee, tea, cooking gas, cleaning utensils, kitchen towels, plates, glasses, cups, and cutlery.
- Fuel: Fuel costs are included in the course fee up to a reasonable estimate for the planned itinerary. In the event of unforeseen circumstances, such as prolonged periods of calm weather requiring excessive engine use, additional fuel costs may be shared proportionally among participants. For example, on a 1000 NM course with an estimated 33% engine use (equivalent to 300 NM or 100 L of fuel), any fuel consumption exceeding this amount will be divided among the crew as an additional expense.
- Other Expenses: Docking fees in the base marina, final cleaning, transit log and tourist tax (via eCrew/eVisitor registration), and VAT.
Not Included in the Course Fee
- Travel Expenses: Flights, travel to and from the marina, and other travel-related costs.
- Insurance: Travel and medical insurance.
- Docking Fees: Docking or mooring fees in marinas and bays other than the base marina.
- Food and Drinks: Food and drinks for the crew and the instructor. Participants are responsible for provisioning for the journey.
Changes and Cancellations
- The Service Provider may change program plans for operational reasons or in the participants' best interest, with timely notification to the person who made the reservation. Such changes will not affect the price.
- Participants may cancel reservations and receive refunds if they find the changes unacceptable.
- Special requests can be made at the time of reservation, but later changes may affect the price.
- In case of organizational issues, The Service Provider may change the time period of the course, offer the course at a different time, or make an alternative agreement.
- The Service Provider may cancel a program due to unforeseen circumstances (epidemic, extreme weather, war, etc.) without any obligation for a refund or compensation for additional expenses incurred by participants.
- Cancellations by the person making the reservation are subject to the following charges:
- 20% of the paid amount for cancellations 30 or more days before the program.
- 50% of the paid amount for cancellations 15 to 29 days before the program.
- 100% of the paid amount for cancellations within 14 days of the program.
- Refunds are not possible for late arrivals, no-shows, or early departures from the program.
- The Service Provider is not responsible for participants' problems in finding the program location.
Security Deposit
- A security deposit is required to cover potential damages to the boat or equipment during the course. While our boats are fully insured with comprehensive coverage (KASKO), the deposit protects against damages caused by improper handling.
- If deemed necessary by the Service Provider, the deposit will be invoiced and is to be paid along with registration fee. The deposit will be refunded in full at the end of the course, provided the following conditions are met:
- There are no damages to the boat or equipment.
- There are no claims or potential claims from third parties related to your use of the boat.
- In case of loss or damage, we will retain the necessary amount (part or whole of the deposit) to cover the cost of repair or replacement. If the damage prevents further rental of the boat, we may retain the total deposit amount to compensate for the loss of income.
- The deposit amount represents the maximum charge for any damage. Any costs exceeding the deposit amount will be covered by our insurance company.
Safety
- Life jackets are available for all participants on board.
- Wearing them is strongly recommended, especially when the instructor deems it necessary, but the final decision rests with you.
- You understand that sailing involves certain risks.
- You assume full responsibility for your actions and their consequences.
- Please follow the instructor's guidance and exercise caution when handling the boat and equipment.
Conduct
- We expect all participants to behave responsibly and respectfully towards others.
- If your behavior jeopardizes the safety of the boat, crew, or other participants, the instructor has the right to remove you from the course.
- In such cases, you are not entitled to a refund or any compensation for any expenses incurred.
Damage to the Boat
- In the event that you cause damage to the boat or equipment through careless handling, you agree to compensate for the damage caused.
- In case a security deposit is in place, please refer to the chapter Security Deposit.
Food and Drinks
- We understand you may consume food and drinks on board that you haven't brought yourselves.
- Please be cautious and assess the freshness and quality of any food items.
- We cannot be held responsible for any health issues arising from consuming food or drinks on the boat.
Weather Conditions
- Normal weather conditions (fog, mist, rain, wind, possible thunderstorms) do not affect program implementation.
- Severe weather may lead to alterations in plans, schedules, and program tempo, at the discretion of the instructor and base manager.
General Terms
- The primary language for lectures is English, unless all participants understand Croatian. Practical instruction uses English maritime terminology, while general communication may be in Croatian or English. Participants are responsible for requesting additional language support if needed.
- Participants are responsible for obtaining necessary insurance, passports, and visas.
- The Service Provider will provide general safety and health instructions. Participants should consult with their physician if necessary and inform the instructor of any health conditions that may pose a risk or hinder participation.
- Instructors are not qualified to provide medical assistance but may do so with explicit permission from the participant, at the participant's own risk.
- Participants are responsible for sun and weather protection, appropriate clothing, and swimming/sea survival skills.
- Participants acknowledge inherent risks and discomfort in sailing programs and release The Service Provider from any responsibility for injuries, damages, losses, or additional costs.
Participant Responsibilities
- Participants must follow instructions from the sailing instructor, base manager, or sales representative and actively perform safety procedures.
- Disruptive or unsafe behavior may result in expulsion without compensation.
- Participants must adhere to the program schedule and actively participate in equipment maintenance and cleanliness.
Complaints
- Dissatisfaction should be immediately reported to the sailing instructor, base manager, or other person in charge.
- Significant or ongoing dissatisfaction can be lodged via email to info@verudasailing.school within 14 days of completing the course.
- The Service Provider will respond to complaints within legally stipulated deadlines.
- Program-specific terms have priority in case of complaints or disputes.
General Disclaimer
- Participants acknowledge and accept inherent risks in sailing, including weather conditions, health issues, physical exertion, and more.
- Consumption of alcohol, cigarettes, drugs, and flammable agents is prohibited on board.
- Participants are responsible for their own medical insurance and acknowledge that medical services may be limited during the program.
- The Service Provider is not responsible for the availability or quality of medical equipment or procedures.
- Participants release The Service Provider from any responsibility for consequences, risks, illnesses, injuries, or death resulting from program participation.
Privacy
- The reservation system requires an account with personal details (name, contact information, special requirements, etc.).
- The person making the reservation must inform other participants about the privacy policy and obtain their consent for data sharing.
- The Service Provider will keep the data up to date, accurate, and complete.
- Personal details may be used outside The Service Provider for service provision, insurance, permits, etc.
- Sensitive information (religious affiliation, health) is collected for the person's protection and may be used in emergencies.
- Refusal to allow the use of sensitive information may result in reservation rejection.
- The Service Provider may use personal details for direct marketing (news, offers, events) based on consent given at the time of reservation.
- Personal details will not be shared with third parties for advertising.
- Persons can opt out of direct marketing by contacting The Service Provider or using the “Unsubscribe” option.
Cookies and Links
- The Service Provider may use cookies to identify computers and track online behavior to improve website experience.
- Preventing cookies via browser settings may affect website and reservation system functionality.
- The website may contain links to other websites, for which The Service Provider is not responsible.
- The website is protected by reCAPTCHA and the Google’s Privacy Policy (https://policies.google.com/privacy) and Terms of Service (https://policies.google.com/terms) apply.
Monitoring
- The Service Provider may monitor and/or record telephone calls, use security cameras, track transactions and activities, and collect geolocation data from boats for quality, safety, and protection purposes.
- All recordings are the sole property of The Service Provider.
Policy Changes
- Veruda Sailing School reserves the right to modify these Terms and Conditions, including prices, at any time.
- Changes to the Terms of Service will be published on the website and reservation system and are available upon email request.
Acceptance of Terms
- By using our services and/or participating in any promotions, you acknowledge and agree to these Terms and Conditions.
- If any provision of these Terms and Conditions is held to be invalid or unenforceable by any applicable law, such provision shall be struck from these Terms and Conditions and the remaining provisions shall remain in full force and effect.
